Terms of Use
A free public service. Use it honestly.
1. Agreement to Terms
By accessing or using the HungryWatch platform, including the website at hungrywatch.com, the web application, and any related services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.
HungryWatch is operated by CloudBuckle Technologies LLC, a California limited liability company ("HungryWatch", "we", "our", or "us"). These Terms constitute a legally binding agreement between you and HungryWatch.
2. What HungryWatch Is
HungryWatch is a community notice board displayed on a map. It is a user-generated content platform that lets community members post notices indicating that they need food (red pins) or have food to share (green pins).
HungryWatch is NOT:
- A food delivery service
- A food bank or food assistance program
- A matching or brokering service
- A party to any food transaction or exchange
- A certifier or inspector of food safety
- A guarantor of any outcome
HungryWatch operates as a passive platform under Section 230 of the Communications Decency Act (47 U.S.C. Section 230). We are not responsible for user-generated content posted on the Platform.
3. Eligibility
You must be at least 18 years old to create an account. Users between 13 and 17 may use the Platform with verifiable parental or guardian consent.
By creating an account you represent that:
- You are at least 18 years old, or have parental consent if between 13 and 17
- You have the legal capacity to enter into these Terms
- You will use the Platform only for lawful purposes
- All information you provide is accurate and truthful
4. Account Registration
4.1 Phone Verification
Account creation requires verification of a valid phone number via one-time password (OTP). One account per phone number. You are responsible for maintaining the security of your account.
4.2 Account Responsibility
You are responsible for all activity that occurs under your account. You must notify us immediately at hungrywatchapp@gmail.com if you believe your account has been compromised.
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time by contacting hungrywatchapp@gmail.com.
5. Acceptable Use
5.1 Permitted Uses
You may use the Platform to:
- Post genuine requests for food when you are experiencing food insecurity
- Post genuine offers of free food available for community members
- View the public map of active pins
- Claim and coordinate a food handoff with another user
- Report pins that violate these Terms
5.2 Prohibited Uses
You may NOT use the Platform to:
- Post false, fabricated, or misleading pins
- Post food that is unsafe, contaminated, or unfit for consumption
- Exchange, solicit, or facilitate the exchange of controlled substances, illegal drugs, or any illegal goods or services
- Solicit or exchange sexual services of any kind
- Request or exchange money, payment, or financial instruments
- Collect personal information from other users
- Post commercial advertising or promotional content
- Harass, threaten, or target any other user
- Discriminate against any person based on race, ethnicity, religion, national origin, immigration status, gender, sexual orientation, disability, or any other protected characteristic
- Require religious participation or belief as a condition of providing or receiving food
- Include phone numbers, email addresses, or URLs in pin notes
- Attempt to circumvent the platform's location privacy protections
- Use automated tools, bots, or scripts to interact with the Platform
- Attempt to access, scrape, or harvest data from the Platform beyond normal use
- Impersonate another person or entity
- Create multiple accounts to circumvent bans or rate limits
5.3 Food Safety
If you post a green pin offering food, you represent that to the best of your knowledge:
- The food is safe for human consumption
- The food has been stored and handled appropriately
- Any known allergens are disclosed in the pin description
- The food is being offered genuinely and without expectation of payment or exchange
HungryWatch does not inspect, certify, or guarantee the safety of any food offered through the Platform. See Section 7 (Platform Disclaimers) for our full disclaimer.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of content you post on the Platform (pin notes, descriptions). By posting content, you grant HungryWatch a non-exclusive, worldwide, royalty-free license to display, store, and transmit that content as necessary to operate the Platform.
6.2 Content Standards
All content you post must comply with our Community Guidelines. Content that violates our guidelines may be removed without notice.
6.3 HungryWatch Intellectual Property
The HungryWatch name, logo, wordmark, design, and Platform software are owned by CloudBuckle Technologies LLC and protected by applicable intellectual property laws. You may not use our trademarks without written permission. See our Copyright Policy for full details.
6.4 Feedback
If you provide feedback or suggestions about the Platform, you grant us the right to use that feedback without compensation or attribution to you.
7. Platform Disclaimers
7.1 No Warranty
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Any food offered through the Platform is safe, accurate, or available
- Any user is who they claim to be
- Any pin will be answered or any need will be met
- The Platform will meet your specific requirements
7.2 Food Safety Disclaimer
HungryWatch is a community notice board. We do not verify, inspect, certify, or guarantee any food, person, or transaction facilitated through the Platform. All food sharing occurs directly between community members. Exercise your own judgment about food safety. If you have concerns about a specific food offer, do not accept it.
7.3 Meeting Safety Disclaimer
HungryWatch suggests public places as meeting locations for food handoffs. These are suggested public locations only. We have no affiliation with them, do not inspect them, and do not guarantee the safety of any meeting or interaction between users. Exercise your own judgment. If you feel unsafe at any point, leave the situation and call 911.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUNGRYWATCH AND CLOUDBUCKLE TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or illness resulting from food consumed through the Platform
- Property damage arising from user interactions
- Loss of data or platform unavailability
- Any outcome of a meeting or interaction between users
- Reliance on any information posted on the Platform
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW.
9. Indemnification
You agree to indemnify, defend, and hold harmless HungryWatch, CloudBuckle Technologies LLC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you post on the Platform
- Any food you share through the Platform
- Any interaction you have with another user
10. Section 230 Notice
HungryWatch is an interactive computer service as defined by Section 230 of the Communications Decency Act (47 U.S.C. Section 230). We are not the publisher or speaker of user-generated content posted on the Platform. We are not liable for content posted by users.
This means: if another user posts false information, unsafe food, or harmful content, HungryWatch is not liable for that content under federal law, provided we did not create or substantially contribute to that content. Our report system and content moderation program are operated in good faith.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
11.2 Informal Resolution First
Before filing any claim, you agree to contact us at hungrywatchapp@gmail.com so we can try to resolve the issue directly. Most concerns can be resolved this way.
11.3 Venue
Any disputes not resolved informally shall be resolved in the state or federal courts located in Ventura County, California.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform, and by SMS to your verified phone number where available, before taking effect. Continued use of the Platform after the effective date of revised Terms constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Platform.
